How can vendors store my credit card details

I went to a lingerie party (party plan sales like Tupperware). I bought some products. 5 months later there is a charge to my credit card. I had not bought anything. I rang the consultant from the party in May who advised me it was a mistake. All customers who use a crdit card to buy things (like me) might want to buy more products from her in the future (I hadn't - my purchase was a one off). She advsied she keeps all credit card details in her safe (so she says - for all I know they could be on her fridge or in a shoebox under her bed)so she can use these details again if customers want to buy something. In my case, she "grabbed the wrong details" and charged my credit card by mistake, instead of the person who bought the goods. She was very soryy and swore it "had never happened before". I did not know she did this with her customers details, nor did I consent to it. I assumed my details would be processed in a head office somewhere. My questions are:- 1). Can my details be stored in such a manner? 2). Was my consent necessary to do so? I am unhappy - but this has been a wake up call - who else does business this way? Do I know where my details are? By the way - she says she can only process a credit to a credit card account if goods are returned. As this is not the case - she can't do it. But she is happy to deposit cash in my bank account!!!! Thanks for your question.

Your problem goes into some perilous legal territory and I'm not qualified to answer it.

On the face of what you're saying, the vendor has not acted appropriately. Under the Privacy Act, anyone who collects your personal information has obligations to disclose the purpose of that information and to store it securely.

I strongly suggest you consult a lawyer. What she's doing -- in particular, the part about not processing a credit refund, sounds very suspicious.
